Barking dogs lead owner to court
A Wellington resident has been hit with a substantial fine and a Criminal Behaviour Order following persistent dog barking that plagued neighbours. Telford & Wrekin Council successfully brought the prosecution after numerous complaints led to a breach of a Noise Abatement Notice.
At Telford Magistrates’ Court yesterday, July 28, the defendant admitted the offence. The court ordered a total financial penalty of £4,817.
Crucially, the Council was granted a Criminal Behaviour Order. This prohibits the individual, who reportedly owns 16 dogs, from acquiring any more. They must also engage with a dog behaviour specialist, and these restrictions will remain in place for five years. Breaking these rules could lead to further penalties, including imprisonment.
Councillor Richard Overton, Deputy Leader and Cabinet Member for Highways, Housing & Enforcement, spoke on the case. “Protecting residents and promoting responsible dog ownership are part of our duties in creating a better borough,” he stated. “This case sends a clear message that we take noise nuisance seriously and will take robust action to protect our residents’ quality of life.”
He added: “We always aim to resolve issues informally, but when legal notices are ignored, we will not hesitate to act. The Criminal Behaviour Order is a significant step in addressing the root cause of the nuisance and preventing further disruption to the community.”
The environmental protection team will continue to monitor the situation. Telford & Wrekin Council can intervene in serious noise problems if they are deemed a statutory nuisance – meaning regular, persistent, and unreasonable, and affecting health or the ability to enjoy one’s home. The time of day, loudness, and duration are all considered.
Residents experiencing issues are advised to speak to their neighbours if safe to do so. Alternatively, noise complaints can be reported 24/7 via the council’s online portal here: https://www.telford.gov.uk/public-protection/environmental-health/pollution/noise/
