Malinslee man gets Community Order and fine for breach of restraining order
A man from Malinslee has been handed a fine and 12 month Community Order for breaching a restraining order.
Scott Carrington broke the restraining order by turning up at the victims house and attempting to gain entry. He was arrested near the scene after being reported to police.
The initial restraining order was granted in response to verbal, physical and mental abuse towards his then partner.
Mr Carrington’s restraining order was due to run out this year and the victim wanted this to be extended. Mr Carrington threatened to punch, strangle the victim and to set fire to the house.
In mitigating, the court was told that defendant suffers from Autism and ADHD and was off his medications at the time of the offence. He also pleaded guilty at the earliest opportunity.
Mr Carrington is remorseful, now back on his medications, and is having access to his child through a third party, said his solicitor.
In sentencing, the court issued a 12 month Community Order, to include 20 Rehabilitation Activity Requirement (RAR) days for a Steps to Change program.
Mr Carrington was also fined £120 plus £85 costs, and £150 compensation to the victim for the breach.
A new restraining order was handed down which forbids the defendant from going to Lightmoor for a period of three years from today, 7th January.
Mr Carrington will pay the fine in £20 per month instalments from his benefits.
